State Legislature Passes Funeral Protest Ban

Posted:

A bill that clarifies a state law banning funeral protests is now headed to Governor Rick Snyder's desk.

The bill that was passed by lawmakers earlier this week with bipartisan support prohibits statements, gestures or conduct that would make a reasonable person attending the funeral or memorial service feel threatened, harassed or intimidated.

The current state law banning funeral protests was previously ruled to vague and unconstitutional by a federal judge last year.

This former law came into existence when in 2007 a couple was escorted from a soldier's funeral procession and arrested for signs that criticized then President Bush.  Charges were eventually dropped and Clare County agreed to pay a settlement
