LANSING, Mich. (WLNS) - One day after a judge dismissed the case against a man police say hit a state trooper while on duty, prosecutors and police are meeting to determine whats next.
Ingham County Prosecutors say they're thinking about appealing and planned to look over the case with State Police.
Thursday, Ingham County judge dismissed the case against Mark Kollar, 50, of Ohio. He was accused of hitting State Trooper Drew Spencer with his car in September of 2011 while Spencer was on a traffic stop on 1-96.
The judge said there wasn't enough evidence to support the felony charge against Kollar.
Trooper Spencer suffered a traumatic brain injury from the accident, but returned to duty in December of 2011.
The defendents attorney said they are sorry for the troopers injuries, but Kollar should have never been charged, saying it was a pure and un-fortuante accident, not a crime. He says prosecutors failed to provide any proof of improper driving by Kollar after the troopers lights came into view.
The prosecutor's office expects to say next week what and if any steps plan to be taken.
