JACKSON, Mich. (WLNS) - Amber Murphy, charged with open murder for the death of her infant son, was back in court Friday.
The prosecution said that within an 18 month period, three people died on her watch, including her 9-month-old son, Seth, who she's charged with killing.
"Two other deaths on her watch. Last person to see them alive. First person to see them dead or almost dead the following morning," said Assistant Prosecutor Kati Remierski.
But Rezmierski argued that she believes these unfortunate coincidences increase the likelihood that the death of Murphy's infant son is not accidental.
"The man who wins the lottery once is envied; the man who wins it twice is investigated," she said.
Murphy's attorney Wendell Jacobs says the prosecution is reaching and trying to find something in a case that isn't strong.
The prosecution is referring to the death of murphy's husband, that according to Jackson County Sheriff's records was ruled a suicide and her former roommate, who according to sheriff's documents died of natural causes from a blood clot in her brain.
"It was proven by the autopsy that's what caused her death. I don't know how they can say my client caused her to have a stroke," said Jacobs.
Jacobs said any information about these two other deaths allowed in the trial will be prejudicial and infringe on Murphy's right to a fair trial.
Judge Thomas Wilson said the prosecution can present the evidence relating to these other deaths at a hearing next month. He'll then decide whether to allow that evidence to be presented during Murphy's trial, which has been postponed.
