Medical Marijuana Caregiver Parents Denied Custody of Child

An Ingham County Judge denied custody Steve and Marie Green custody of their six-month-old daughter Brielle, but granted them unlimited visits under third party supervision.

Ingham County Probate Judge Richard Garcia upheld a decision by a Child Protective Services referee one week ago, which determined the Green household unsafe for a child, because both parents are medical marijuana patients and marijuana growers.  

Judge Garcia also amended the orginal decision to exclude Elliot, Maria Green's six-year-old son from a previous marriage, from any custody bans because Elliot lives with her former husband and does not regularly stay in the Green household.

"The refereees decision of the palcement with the agency of the child was appropriate," said Garcia, " Marijuana is being used in front of children, not in a locked facility, not in exclusion of children."

"If we weren't medical marijuana patients we'd still have our baby," said Marie Green.

Both parents say the accusation that pot was used in front of the kids simply isn't true. They say they've used other vapor substances, never exposing their child to THC.

"There's no cannabis in this and there's nothing wrong with it it's like an e-cigarette," said Steve Green who offered a demonstration, taking a puff of vapor from an electronic smoking device outside the courtroom.

The Greens say they're not satisfied with the outcome, but say they are happy they can at least see their daughter Bree.

"I'll now be able to go spend more than three hours with her so that's kind of the silver lining," said Marie.

Marie and Steve say they are planning to take the matter to trail, and will appear in court again October 7th.
