Woman Not Charged With Motorcyclist's Death After Fatal Accident

MASON, Mich. (WLNS) - A Jackson woman pled guilty in court Monday after a fatal collision with a motorcyclist this summer.

Police say Tina Poland, 49, hit and killed Todd Carr, 45, of Pleasant Lake, while he was riding a motorcycle on July 26.

Poland pled guilty of driving under the influence and driving with a suspended license.

She originally faced charges for Carr's death, until the accident reconstruction. "It's totally unclear as to whether she was the cause of the accident or he, the decedent, was the cause of the accident," said Stuart Dunnings III, the Ingham County Prosecutor. He says it's not common where the reconstruction doesn't determine what happened.

"He had drove 12 miles at that point on windy, wet roads. Never had an accident with any kind of problems until he met Ms. Poland," said Larry Carr, Todd's brother.

Both were driving under the influence, Poland with a 0.09 blood alcohol level and Carr with a 0.24. Carr's family said they're finding it difficult to accept the report, as they don't think his reading was a true reading.
