GENOA TOWNSHIP, Mich. (WLNS)- No criminal charges will be filed against the EMS driver involved in an accident that left one man dead.

According to our media partners at WHMI, the prosecutor says there wasn't enough evidence to justify charges.

The accident happened back in November on Grand River Avenue in Genoa Township. Officials say 49-year-old Patrick Billo of Howell was lying on the road, when he was hit by the ambulance.

Autopsy results showed Billo had a blood alcohol content of .24 at the time of his death.
