ACLU Speaks Out On Same Sex Marriage Legal Rights

Posted: Updated:

LANSING (WLNS) - On Saturday hundreds of same sex couples rushed to county clerks offices to "legally marry" before a judge could "put a stop" to being able to do so.

Does that mean they have married benefits now?

But the ACLU says legal marriage equals legal benefits.

Shell Weisberg of the Michigan ACLU says if the marriages are legal they're legal for all benefits.  He adds that denying any legally married couple their benefits is a constitutional violation.

Weisberg points to the historic Detroit case in which a Federal judge ruling in favor of a gay couple began with their rights to adopt each other's children.

That's one of the marriage benefits same-sex couples are still denied under the Governor's order.

Weisberg says there's no time-frame on when the ACLU could begin taking legal action but says there's no shortage of same-sex couples ready and willing to work with the organization.

On Saturday hundreds of same sex couples rushed county clerks offices to legally marry before a judge could put a stop on their ability to do so. On Wednesday Governor Snyder said those couples, while legally married, don't have married benefits.
