Judge Excludes ‘Discovery’ Process In Frandor Vs. Lansing Lawsuit

LANSING, Mich. (WLNS) – The legal battle over a special drainage assessment connected to the city of Lansing’s proposed Red Cedar Renaissance project continued this week when an Ingham County Circuit Court judge ruled to exclude the discovery process from the proceedings.

Discovery allows defendants and plaintiffs to know what evidence each side will present in court.

Ingham County Drain Commissioner Pat Lindemann on Thursday called the ruling a small victory for the City of Lansing. Lindemann is overseeing a project that will restructure the Montgomery drain, which the city argues is necessary to complete the multi-million dollar project. The development will sit in Lansing’s old Red Cedar Golf Course along Michigan Avenue, on the city's far east side.

“This is a huge economic boost for the city,” said Lindemann. “We have a lot of out-of-state money [that’s] going to come in here, hundreds of millions of dollars being invested in this area, creating thousands of jobs. There’s no down side to this at all.”

Owners of the Frandor Shopping Center disagree, calling the special drainage assessment unfair, since they are not part of the Red Cedar project. Lindemann called the lawsuit premature, but T.J. Bucholz, a spokesman for Frandor owners, said it’s an assertion of owners’ rights, and they should be able to have a say in the assessment before a final decision is made. Bucholz said his clients do not believe the judge's ruling will have a significant impact on the case. 

A hearing will take place in July.
