Digital Death: What Happens To Your Social Media Accounts When You Pass

EAST LANSING, MI (WLNS) - Should your social media go with you when you die? Or should it live on, even though you aren't.

Interestingly enough, the answer lies in the Terms of Service Agreement each company forces you to read and approve before getting started with your social account.

Think about all of the social media outlets you engage in. 

Whether it be Facebook, Instagram, Twitter, or even your email accounts.

The Internet is a public forum, and because of that, companies could have the rights to your account even if you're deceased.

Some people believe their social media accounts aren't necessary to remain activated if they are dead.

"If I got to choose, I would like it to get deleted, just because I wouldn't want people writing all over my Facebook wall," says Alicia Lepage.

Others like Jacob Santos, think differently. 

"I've talked to my best friend about this, If I die, my social media legend will live on," Santos says." I gave her my passwords so she will be able to run it."

According to Attorney Joseph Abood, the Uniform Law Commission is planning to make a recommendation to states this week to enact certain laws that allow people through state planning to determine where they want their digital accounts to go.

"Then you would have a law determining this as opposed to your term of service agreement with the companies that provide these services," Abood says.

Abood went on to say that because privacy issues involved with social media accounts are significant, a person would need a court order in order to access an account of a deceased person even if you are a family member.
