Attorney General Schuette Warns Against Gas Price Gouging

Posted: Updated:
(WLNS) - Labor Day weekend is traditionally the last vacation of the summer for many Michigan residents.

Michigan Attorney General Bill Schuette is warning retailers against attempting to take advantage of consumers by price gouging or price fixing leading up to and during the holiday.

"Michigan consumers should not being taken advantage of during their last vacation of the summer, " said Schuette.  "We will not tolerate price gouging or price fixing.  We are watching and will not hesitate to take action if retailers break the law."

Schuette has released an infographic for consumers called Price At The Pump, which explains the average costs, fees and taxes that go into the cost of a gallon of gasoline.

The Michigan Attorney General's Office monitors wholesale and retail prices in areas around the state. The office investigates any time there is evidence that state law has been violated by gouging or price fixing.

Under the Michigan Consumer Protection Act, a retailer may not charge a price that is "grossly in excess of the price at which similar property or services are sold."  Anti-trust laws also prohibit gas stations from hearing into agreements to arbitrarily fix prices in unison.

In 2012 five Michigan station owners were convicted of gasoline price-fixing.  If consumers are aware of direct evidence of a conspiracy between companies, or have verifiable evidence of a retailer charging prices that would meet the price fix definition, they are encouraged to contact the Attorney General's Consumer Protection Division at 10877-765-8355 or file an online complaint.  Consumers can also get more information on gas prices in the state in a consumer alert from the Attorney General.
