Judge steps aside in Dunnings case

DEVELOPING (WLNS) – A judge has recused herself from the sentencing of former Ingham County Prosecuting Attorney Stuart Dunnings III.

Ingham County Circuit Court Judge Rosemarie Aquilina today stepped aside and another judge will take over the sentencing phase.

That judge has not been named.

The attorney for Dunnings had filed a motion to disqualify Judge Aquilina and to adjourn the sentencing date.

Dunnings was in court today and is scheduled to be sentenced November 10 but that could change with the judge reassignment.

In August Stuart Dunnings III pleaded guilty to misconduct in office, a felony, and one charge of engaging the services of a prostitute, a misdemeanor. As part of the deal the Attorney General agreed to dismiss fourteen other charges.

The felony misconduct in office is punishable by up to five years in prison.
